Why is the EU considering new legislation?
The Commission’s fitness-check work identified continuing consumer-protection challenges in digital markets and framed the DFA as a possible response. That policy diagnosis does not itself create a duty for businesses. Review of EU consumer lawDigital Fairness Act: call for evidence for an impact assessment
- Track official initiative documents rather than press summaries.
- Separate evidence about a policy problem from the wording of any eventual rule.
- Keep present-law compliance work distinct from future-readiness planning.
What is already regulated?
The UCPD, CRD, UCTD, DSA, GDPR and sector instruments already regulate different aspects of commercial presentation, information, contracts, platform design and personal data. Their scope, actors, tests and remedies differ; similar interface facts can require several separate analyses.
